Terms of Service

1. Acceptance

By creating an account or using Ascend ("the Platform"), you agree to these Terms. If you do not agree, do not use the Platform.

2. Eligibility

You must be 18 years or older to use the Platform. By registering, you represent that you meet this requirement. Accounts found to belong to minors will be closed and balances handled at our discretion.

3. The Service

Ascend is a predictions market offering prediction contests on the future value of tradeable assets (e.g., sneakers, trading cards, digital items) listed on third-party marketplaces. Users select whether the value of an asset will settle above or below a stated line at a stated valuation time. Ascend is not a broker, exchange, or investment platform, and no purchase or sale of any asset occurs on the Platform.

4. Entry Fees and Payouts

(a) Each parlay requires an entry fee paid at submission. Entry fees are non-refundable except where a market is cancelled — see Section 5(e).

(b) Winning parlays are paid the displayed multiplier of the entry fee.

(c) Winnings accrue to your payout balance and are paid via PayPal to the email on file, subject to a $5.00 minimum, processed within 24–48 hours of request or settlement.

(d) You are responsible for the accuracy of your PayPal email; payouts sent to an address you provided are final.

(e) You are solely responsible for any taxes on winnings.

5. Market Rules

(a) Each market displays a line, a picks-close time after which no predictions are accepted, and a valuation time at which the official value is determined.

(b) Your prediction locks the line displayed at the moment of submission; subsequent line movement does not affect locked predictions.

(c) The official value at valuation time is determined per the settlement method published for each marketplace (e.g., average of the last N completed sales for the specified asset variant, such as size, as of valuation time).

(d) Lines are set with a fractional offset such that exact ties cannot occur.

(e) If a market is cancelled, affected legs are voided; parlays are recalculated at the next lower multiplier tier. Where no legs remain, the entry fee is refunded in full automatically to the original payment method used at submission, typically arriving within 5–10 business days depending on your bank or card issuer. Refunds are never credited to a payout balance.

(f) All predictions in a parlay must be correct to win; one incorrect leg results in loss of the entire entry fee.

6. Settlement Finality

Settlements recorded by the Platform are final except in cases of demonstrable technical error. The Platform may correct errors and adjust balances accordingly, with notice.

7. Account

One account per person. You are responsible for safeguarding your credentials. We may suspend accounts for suspected fraud, multi-accounting, manipulation of settlement inputs, or abuse of platform errors.

8. Prohibited Conduct

No use of bots or automated pick submission; no collusion; no exploitation of bugs (report them instead); no abuse, harassment, or illegal content in comments; no attempting to manipulate asset prices on third-party marketplaces to influence settlement.

9. Platform Rights

We may add, remove, suspend, or cancel markets; modify multipliers, limits, and fees for future markets; and suspend the Platform for maintenance, with reasonable notice where practicable.

10. No Financial Advice

Nothing on the Platform constitutes investment, legal, or tax advice. Asset price history and community data are informational only.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE AVAILABILITY, ACCURACY OF THIRD-PARTY MARKET DATA, OR UNINTERRUPTED SERVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100 OR THE ENTRY FEES YOU PAID IN THE 3 MONTHS PRECEDING THE CLAIM.

13. Dispute Resolution; Arbitration

Any dispute arising from these Terms or the Platform shall be resolved by binding individual arbitration under the rules of the American Arbitration Association, and not in court, except that either party may bring claims in small claims court. YOU WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Delaware law governs.

14. Changes

We may update these Terms with notice via the Platform or email. Continued use after the effective date constitutes acceptance.
